On May 13, The Environmental Protection Agency (U.S. EPA) issued an interim final rule in the Federal Register (vol. 90, no. 91). The interim final rule delays PFAS reporting under the Toxic Substances Control Act (TSCA), Section 8(a)7 until April 13, 2026. This is a nine month delay from the former reporting period.
PFAS reporting submissions will now open on April 13, 2026, and close on October 13, 2026. For small manufacturers, submissions will not be due until April 13, 2027.
U.S. EPA has instituted this delay as it requires additional time to develop its reporting software. U.S. EPA is also considering reopening public comment in a future separate action in light of Executive Order 14219, focusing on deregulation.
